Intellectual Property

The focus of Russell McVeagh's IP practice is assisting clients with respect to both contentious and transactional intellectual property issues.

We assist our clients with contractual and transactional advice relating to intellectual property assets. This includes joint ventures, licensing arrangements, research and development arrangements, and IP collaboration/development arrangements.

The clients we regularly act for in this regard include some of New Zealand's largest corporates, multi-national entities, and businesses for whom intellectual property is a key asset.

Our intellectual property litigators advise on all disputes involving intellectual property including trademarks, copyright, designs, confidential information, passing off, unfair trading (including the Fair Trading Act 1986 and the economic torts), consumer law and defamation. We are experienced in seeking emergency interim relief to protect our client's intellectual and confidential property interests. Together with the Public Law and Policy Group we regularly work with clients on submissions to Parliamentary Select Committees on legislation affecting intellectual property rights.

Our intellectual property clients include major local and international corporates in the telecommunications, pharmaceutical, food and beverage, media, and sporting industries. With respect to the latter, we also advise on issues in connection with the organisation and sponsorship of major events.

The firm no longer offers a trade mark registration service. We have a referral relationship to specialist firms for such a service.

Key partners in this specialty are Graeme Quigley and Derek Johnston (IP corporate) and Sarah Armstrong, Michael Heron and Sarah Katz (IP litigation).
