Fisheries

With the passing of legislation settling fisheries allocation and aquaculture space entitlement for Māori, there are implications for government structures and the opportunities both allocation and aquaculture space provide for future development.

Our firm has been involved in both the fisheries and the aquaculture allocation since the 1990s. We have also participated in detailed negotiations over legal structures with Te Ohu Kai Moana and have implemented those structures.

Finally with the advent of the Foreshore and Seabed Act 2004 our firm has continued a long history of working and representing Māori seeking to clarify their rights to the foreshore and seabeds of their areas.

The scope of work we have undertaken in this area includes:

Fisheries 

  • Representing iwi before Select Committee hearings on the Māori Fisheries Settlement legislation. 
  • Advising iwi in the process of gaining acceptance for fisheries allocation. 
  • Drafting the template governance deed promoted by Te Ohu Kai Moana as compliant.
  • Advising iwi establishing fishing companies and joint ventures.

Aquaculture 

  • Representing iwi before Select Committee hearings on the Māori Commercial Aquaculture Claims Settlement legislation. 
  • Securing large scale marine farm consents for New Zealand's largest private Māori marine farming company. 
  • Representing iwi in the review of the government's aquaculture policy and legislation in the Waitangi tribunal. 
  • Advising iwi establishing Iwi Aquaculture Organisations under the Māori Commercial Aquaculture Claims Settlement Act 2004. 
  • Advising iwi on the establishment of aquaculture projects and applications for consent.

Foreshore and Seabed 

  • Representing iwi in the High Court and Court of Appeal proceedings of Ngati Apa & Anr v Attorney-General and Ors. 
  • Representing iwi in the Waitangi Tribunal inquiry into Foreshore and Seabed Policy. 
  • Representing iwi before Select Committee hearings. 
  • Representing Whakatohea in the first application to be considered in the Māori Land Court under the Foreshore and Seabed Act 2004.
