Malcolm, a partner since 2003, specialises in commercial litigation and dispute resolution, including construction, insolvency and employment law. His practice includes acting on matters involving emergency and urgent relief orders and complex contractual and statutory interpretation issues. more

Malcolm originally joined Russell McVeagh in 1992, before leaving to study for his post graduate degree at Oxford University. Malcolm then worked as a Labour Law and Labour Relations specialist at the International Labour Office in Geneva before returning to Russell McVeagh in 1998. Malcolm is an experienced advocate in all Courts, including the Court of Appeal, High Court and District Court. He is also experienced in appearing before both the Securities Commission and Takeovers Panel and in commercial arbitrations.

Transaction Experience

  • Acting on and obtaining urgent emergency relief including mareva injunctions, Anton Pillar orders and preservation of property orders. 
  • Advising and acting on major contractual disputes including formation, breach, termination and damages issues. 
  • Advising and acting on significant negligence claims including duty of care, breach, causation and damages issues. 
  • Acting on construction disputes (including vessel construction disputes), including major construction arbitrations for developers and contractors and applications for interim protective measures. 
  • Acting in Maori Land Court proceedings concerning the sale of forestry interests. 
  • Counsel in numerous property disputes and arbitrations, including rent reviews, and in the High Court. 
  • Advising and acting on personal grievances, including pursuing and defending grievances through mediation and adjudication, and taking appeals to the Employment Court.
  • Regularly advising on employment issues arising from the sale and purchase of businesses. 
  • Drafting and enforcing employment contracts including deeds of restraint and termination.
  • Providing advice on health and safety compliance, defending health and safety prosecutions.
