Background:

Derek is a highly regarded practitioner in the environmental law field.

He is both strategic adviser and counsel on significant retail and commercial property developments for a variety of clients. more

His practice includes advising on all types of industrial projects, ports and other coastal projects, residential developments, airport planning and environmental due diligence and auditing. He is the editor and an author of the widely consulted "Environmental and Resource Management Law" (3rd ed).

 

He has been a partner since 1984.

Transaction Experience

  • Advising Westfield in its successful negotiations with Transit New Zealand about the proposed $150m replacement Newmarket Viaduct section of State Highway 1 and Westfield's proposed $200 million retail development, as well as seeking approval of Westfield's retail development. 
  • Acting for Auckland International Airport on environmental issues arising from the construction of its second runway and associated facilities. 
  • Advising on airport and aviation activities for Auckland International Airport, Air New Zealand and the Board of Airline Representatives of New Zealand. 
  • Acting for Ports of Auckland on the rezoning of the western reclamation in Auckland for mixed use development which will be New Zealand's largest waterfront development. 
  • Advising on ports projects and port planning for the Ports of Auckland Limited, Port Napier Limited, Westgate Transport Limited (Port Taranaki), Centre Port Limited and Lyttleton Port Co Limited. Representing all 13 port companies in New Zealand on environmental issues affecting the industry generally. 
  • Advising on coastal and land development projects for Gulf Harbour Limited, Kaipara Limited, Pine Harbour Marine Limited and Auckland Waterfront Advisory Group. 
  • Acting on retail, commercial and residential developments including for Westfield (NZ) Limited, St Lukes Group, AMP, Progressive Enterprises, Perron, and Broadway Park. 
  • Advising on water and waste infrastructure, including approvals for upgraded plant, new facilities, renewals of consents and related issues for Watercare Services Limited. 
  • Advising on a wide range of forestry or forest related industrial activities for Carter Holt Harvey. 
  • Advising on many regional policy statements, regional plans and district plans under the Resource Management Act 1991. 
  • Appearing before numerous Select Committees of Parliament in support of submissions on legislation.
